Representative Matters

Officer & Director Defense. Within 45 days of engagement, obtained order dismissing claims by Dallas Stars professional hockey team against owners of youth-league hockey facility, including fee award. 

Shareholder Derivative Action. Defended attorney against malpractice and fiduciary duty claims by shareholder. Obtained order striking plaintiff’s privilege claims under offensive-use doctrine. Deposed critical damages expert and obtained order excluding plaintiff’s $4.5 million damages theory. 

Securities Litigation. Represented receiver in clawback claims ancillary to S.E.C. securities fraud action in connection with mortgage scheme. Spearheaded claims investigation and assisted in obtaining presuit settlements in excess of $2 million. 

Trade Secrets. Obtained TRO, permanent injunction, and favorable resolution for national physician-staffing agency on claims of trade secret misappropriation against former employee and competitor.

Breach of Contract. Second-chair at trial obtaining six-figure judgment for cosmetics distributor on third-party beneficiary contract claim. Prepared briefs on appeal affirming the judgment. 

Construction Arbitration. Second-chair attorney in arbitration proceeding resulting in multimillion dollar award for HOA against international homebuilder for construction defects at townhomes.
